Terms and Conditions

Important Notice

These Terms and Conditions apply to users who are consumers under the Consumer Protection Act, 68 of 2008.
These Terms and Conditions contain provisions which:
- May limit the risk and liability of Power Home;
- May create risk or liability for the user;
- May require the user to indemnify Power Home;
- Serve as an acknowledgment of certain facts by the user.
Your attention is drawn to these Terms and Conditions and should be carefully noted.
Nothing in these Terms and Conditions is intended to unlawfully restrict, limit, or avoid any right or obligation created for either you or Power Home under the CPA.
By using this website in any way, you are deemed to have accepted all the Terms and Conditions unconditionally.

Conclusion of Sales and Availability of Stock

Users may place orders for products, which may be accepted or rejected. Whether or not Power Home accepts an order depends on availability, correctness of the information relating to the products (including without limitation the price), and receipt of payment to Power Home for the goods.
Power Home will indicate the acceptance of your order by delivering the goods to you, and only at that point will a sale agreement between you and Power Home come into effect (the “Sale”). Power Home will indicate the rejection/cancellation of your order by cancelling it and refunding you in full.
You may cancel an order at any time, provided you do so before receiving a delivery notice. After delivery, you may return the goods only in accordance with the Returns and Warranty Policy.
Power Home reserves the right to reject any payment of a quotation if the prices of the products have changed during the checkout process.
You acknowledge that stock on offer is limited and that pricing may change at any time. In the case of goods for sale by Power Home, we will take reasonable efforts to monitor stock levels. However, we cannot guarantee the availability of stock. When products are no longer available after purchase, Power Home will notify you and refund you in full.
Power Home deals, discounts, and prices are available for a specified time period and/or while stocks last:
- All pricing is valid while stocks last.
- An order is only confirmed at the time of an online order confirmation or when full payment reflects in the Power Home bank account.
- Power Home reserves the right to reject a confirmed order should stock be sold out. Refunds will be processed according to our refund policies.
- All installations are scheduled on a first-come, first-served basis.
- Any queries or complaints regarding deliveries, installations, or customer service should be emailed to sales@powerhome.co.za.

Payment

We are committed to providing secure online payment facilities. All transactions are encrypted using appropriate encryption technology.

Payments can be made via:

Debit Card.
Credit Card: We may require additional verification and validity of payment. Once full payment has reflected in the bank and your payment confirmation has been received, goods will be delivered to your desired address. You confirm that you are fully authorized to use the credit card for payment.
Direct Bank Deposit or Electronic Funds Transfer (EFT): If you pay via direct bank deposit or EFT, payment must be made within 5 days of placing your order. Power Home will not accept your order if payment has not been fully received.
Instant EFT.

Power Home will send you a confirmation email about your order and payment.

How to Order Products

You can order products by going to the specified products section on the navigation bar or using the search engine to filter your choices. Once you have added everything you need to your shopping basket and clicked “checkout now,” fill in the required information. Once you click on ‘place your order,’ your order is final. This means you will have to pay the purchase price.
If any scenarios of non-acceptance apply, Power Home may reject or cancel your order, in which case we will refund any payment you have made.
Once you have placed your order, you will receive an order confirmation by email or a sales follow-up call.
We will process your order as soon as we have received your payment.

Delivery of Goods

Power Home offers door-to-door delivery service for all products purchased via the Power Home website. Orders are delivered by a third-party courier.
Our delivery charges are subject to change at any time, without prior notice to you.
Power Home will usually deliver the goods within 3-7 working days, but no later than 30 days of receipt of your payment. We will communicate with you if we are unable to deliver the goods during the Delivery Period specified on the product that you have purchased. You may then, within 7 days of receiving such notification, decide whether or not to cancel your order. If you decide to cancel your order, we will reimburse you in full. This notice can be informed to us by email, phone call, or WhatsApp message.
Power Home shall not be liable for any loss, claim, or expense relating to a successful delivery once a proof of delivery has been signed and sealed.
Power Home's commitment to deliver a product to you is successful once the product is physically at your specified address. Power Home is not liable for any loss, damage, or unauthorized use of the product you purchased after it has been delivered.

Cancellation of Orders

If you no longer wish to receive the order, you can log a cancellation via email (sales@powerhome.co.za). This needs to be done on the same day that your order is placed before the order goes out for delivery the following day. If you wish to log a return, you can do so by email upon receiving your parcel. The item will then be collected from you at a courier fee of R450 plus a handling fee of 8% of the purchase price, which will be deducted from your refund once the items are returned to our warehouse.

The use of the website is entirely at your own risk, and you assume full responsibility for any risk or loss resulting from the use of the website or reliance on any information on the website.
While Power Home takes reasonable measures to ensure that the content of the website is accurate, Power Home makes no representations or warranties, whether express or implied, as to the quality, timeliness, operation, integrity, availability, or functionality of the website or the accuracy, completeness, or reliability of any information on the website. If any such representations or warranties are made by Power Home representatives, Power Home shall not be bound thereby.
Power Home disclaims liability for any damage, loss, or expense, whether direct, indirect, or consequential in nature, arising out of or in connection with the access to or use of the website and/or any content therein unless otherwise provided by law.
Although goods sold from the website may, under certain specifically defined circumstances, be under warranty, the website itself and all information provided on the website is provided "as is" without warranty of any kind, either express or implied, including, but not limited to, the implied warranties of merchantability, fitness for a particular purpose, completeness, or non-infringement, as may be allowed by law.
Any views or statements made or expressed on the website are not necessarily the views of Power Home, its directors, or agents.
In addition to the disclaimers contained elsewhere in these Terms and Conditions, Power Home also makes no warranty or representation, whether express or implied, that the information or files available on the website are free of viruses, spyware, malware, trojans, destructive materials, or any other data or code which is able to corrupt, destroy, compromise, disrupt, disable, harm, jeopardize, or otherwise impede in any manner the operation, stability, security, functionality, or content of your computer system, computer network, hardware, or software in any way. You accept all risks associated with the existence of such viruses, destructive materials, or any other data or code which is able to corrupt, compromise, jeopardize, disrupt, disable, harm, or otherwise impede in any manner the operation or content of a computer system, save where such risks arise due to the gross negligence or willful misconduct of Power Home. Power Home thus disclaims all liability for any damage, loss, or liability of any nature whatsoever arising out of or in connection with your access to or use of the website.

Limitation of Liability

Power Home cannot be held liable for any inaccurate information published on the website and/or any incorrect prices displayed on the website, save where such liability arises from the gross negligence or willful misconduct of Power Home. You are encouraged to contact us to report any possible malfunctions or errors.
Power Home shall not be liable for any direct, indirect, incidental, special, or consequential loss or damage which might arise from your use of, or reliance upon, the website or the content contained on the website and/or any linked third-party website.
You hereby indemnify Power Home against any loss, claim, or damage which may be suffered by yourself or any third party arising in any way from your use of this website and/or linked third-party website.

Availability and Termination

We will use reasonable endeavors to maintain the availability of the website, except during scheduled maintenance periods, and are entitled to discontinue providing the website or any part thereof with or without notice to you.
Power Home may, in its sole discretion, terminate, suspend, and modify this website, with or without notice to you. You agree that Power Home will not be liable to you in the event that it chooses to suspend, modify, or terminate this website, other than for processing any orders made by you prior to such time, to the extent possible.
If you fail to comply with your obligations under these Terms and Conditions, including any incident involving the payment of the price of an order for any goods, this may (in our sole discretion with or without notice to you) lead to a suspension and/or termination of your access to the website without any prejudice to any claims for damages or otherwise that we may have against you.
Power Home is entitled, for the purposes of preventing suspected fraud and/or where it suspects that you are abusing the website and/or have created multiple user profiles to take advantage of a promotion or coupon intended by Power Home to be used once-off by you, to blacklist you on its database (including suspending or terminating your access to the website), refuse to accept or process payment on any order, and/or to cancel any order concluded between you and Power Home, in whole or in part, on notice to you. Power Home shall only be liable to refund monies already paid by you (see Power Home Returns Policy in this regard) and accepts no other liability which may arise as a result of such blacklisting and/or refusal to process any order.
